These Terms of Use ("Terms") govern your access to and use of the CommTrack mobile application ("App") and website, developed and operated by Armando Lazaro Ferro Diaz ("Developer," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not download or use the App.
By creating an account or using any part of the App, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be legally bound by them.
CommTrack is a commission management application designed for automotive sales professionals. The App allows users to:
The App is a personal productivity tool. Commission calculations are based solely on the data and rules you enter. The Developer is not responsible for any discrepancies between App calculations and actual payroll or dealership records.

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App, including its design, code, graphics, logos, and content, is the exclusive property of Armando Lazaro Ferro Diaz and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or lease any part of the App without prior written permission from the Developer.
You retain ownership of all data you enter into the App (sales records, commission settings, client information, etc.). By using the App, you grant us a limited license to store and process that data solely for the purpose of providing the App's services to you.
You are responsible for the accuracy of the data you enter. The App's commission calculations are only as accurate as the data and rules you provide.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.
Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.
We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Virginia.
